1. Inhloso

1.1 Inhloso ka Ombudsman ukuthola kanye nokubuka izikhalazo ngendlela axazulule, enze kuxolelwane,aphinde anikeze indlela yokuxazulula noma anikeze isiphelo sesikhalazo.

1.2 Inhloso ka Ombudsman bazo bona uguthi bazo Qinikisekisa loku:

1.2.1 Inhloso ka Ombudsman ukuthola kanye nokubuka izikhalazo ngendlela axazulule, enze kuxolelwane,aphinde anikeze indlela yokuxazulula noma anikeze isiphelo sesikhalazo;

1.2.2 Kumele kolandelwe ezindlela ezingenamibandela eminingi ezingachemile nezingadli kakhulu ephaketheni;

1.2.3 futhi uzobhalansisa phakathi kwabafake izikhalo kanye namalungu;

1.2.4 nokuthi uzobuka ukulingana;

1.2.5 nokuthi uzokwenza kube yimfihlo ngokulandela umthetho wa 7 lapha ngaphansi ngokubukwa kwezikhalazo ezitholiwe;

1.2.6. usebenzisana noMkhandlu osungulwe ngokoMthetho Wokulawulwa Komkhakha Wezezimali, (uMthetho wesi-9 wezi-2017), ekugqugquzeleni ukuqwashisa umphakathi ngobukhona, ukusebenza kanye nokusebenza kuka-Ombudsman kanye nehhovisi lika-Ombudsman kanye nokwazisa abathengi nangamathuba akhona. abamangali bezinkundla ezikhona zokuxazulula izingxabano;1.2.7. amalungu abhalisile enza ngokungenzeleli nangokuhlonipha kokubili incwadi nomoya wenkontileka phakathi kwezinhlangano futhi anikeze isevisi ephumelelayo kulabo abenze isivumelwano nabo;

2. Amandla Eskikhundla

2.1 Ngokwemithetho ka 2.2 no 2.3 lapha ngaphansi u Ombudsman uzothola futhi abuke zonke izikhalazo zomuntu onepholisi yentshwalense, umuntu oyomlandela noma udlamafa ngendlela ilungu lelo elimdayisele ngayo, ukwenziwa noma ukuvalwa kwayo ipholisi nanoma iyiphi ke edayiswe lapha emzansi afrika.

2.2 Ombudsman akasoze asibuke isikhalazo uma:

2.2.1 kuthathwe izinyathelo zomthetho ngesikhathi isikhalazo sisabukwa u Ombudsman noma;

2.2.2 noma u Ombudsman sewake wayibuka ngaphandle uma ngabe sekunobufakazi obusha obungaba nomthelela ngesinqumo sika Ombudsman;

2.2.3 Uma iminyaka emithathu noma ngaphezulu isidlulile kusukela ngosuku lowo owayenesikhalo wazithola engakwazi ukufaka isikhalazo sakhe futhi ngenxa yezizathu ezithile ezamenza wangenzi njalo, futhi angeke abekwe icala ngokungasifaki.

2.3 Kumele isikhalazo singathinti lokhu:

3. Indlela Yokwenza

3.1 U Ombudsman uzothola izikhalazo ezibhalwe phansi, ahlunge imininingwane noma asebenzise ubuchule lapho kudingeka khona azame ukuxazulula izinkinga ngokwendlela yokulamula, ngokushweleza, akhulumele uma kungaphumeleli anikeze isinqumo sokugcina.

3.2 Isinqumo sokugcina kungaba ilokhu:

3.2.1 asichithe isikhalazo salowo osifakile;

3.2.2 asekele isikhalazo ngokuphelele noma ingxenye yaso;

3.2.3 asilahle isikhalazo ngokuphelele;

3.2.4 enze isinqumo ngendlelayokwenza noma ngobufakazi obulethiwe;

3.2.5 anikeze isinxaphezelo, ngisho noma kubukwe umthetho ka 3.2.2 noma u 3.2.3 ngoba lowo ofake isikhalazo ebesenkingeni yemali ngenxa yephutha noma angatshelwa izinto noma ngendlela yokuphatha okubi( kuhlanganiswa ukubonakalisa okungafanele noma ukungawazi umsebenzi) kulelo lungu elithintekayo ngaphandle kokuthi leyomali ngeke idlule u R15 000 noma leyomali yoshiwo I Ombudsman Council ngokuhamba kwesikhathi;

3.2.6 Futhi kophinde kufunwe ilungu likhokhe intela emva kokuzama zonke lezinqumo sezikhishiwe akhokhe kusuka ngosuku lapho etholakala ukuthi inozwela futhi sibe sikhona isidingo.

3.3 U Ombudsman angasilahla isikhalazo esifakelwe kwilungu uma kuvela ukuthi imininingwane enikeziwe:

3.3.1 kuyabonakala ukuthi lowo ofake isikhalazo angeke aze aphumelele noma;

3.3.2 uma isikhalazo silandelwa ngendlela enganasisindo, ngendlela yokucunukisa noma iyahlukumeza noma;

3.3.3 uma kubonakala ukuthi lowo ofake isikhalazo ngeke athinteke, ngokwezimali ngokomthetho ka 3.2.5

3.4 Uma ngabe lowo ofake isikhalazo noma ofakwe isikhalazo enganikezi ulwazi ecelwe ngu Ombudsman ngaleso sikhathi esinqunyelwe , ngakho ke u Ombudsman unelungelo lokuthi akhiphe isinqumo sakhe ngokuthi abuke kuphela leyomniningwane enikeziwe kuphela.

3.7 Kukho konke ukushitshisana ehovisini lika Ombudsman kanye nofake isikhalazo kanye nelungu nazozonke izincwadi ezenziwe kuyokuba isivumelwano futhi ngeke zisakazwe kubantu bangaphandle, iyogcina inkatolo noma kulabo abathintekayo.

 

4. I Prescription

Ukutholakala kwesikhalazo ngu Ombudsman ichitha konke obekukade kusesivumelwaneni noma ngokwe Prescription Act (Act 68 ka 1969) kusukela ngalesikhathi sokuthola kuze kuze kuhoxishwe isikhalazo ngokuka Ombudsman noma ukuncenga ngokwemithetho isichithiwe.

 

5. Ulwazi ngo-Ombudsman

Amalungu abhalisele azodalula ukutholakala kanye nemininingwane yokuxhumana ye-Ombudsman ku:

5.1 abanikazi bamapholisi lapho kudayiswa khona nasekuxhumaneni ngezikhathi ezithile okufanele;

6. Uxhaso

Amalungu Abhalisele azokhokha amalevi kanye nezimali zecala ezikhokhiswa u-Ombudsman, ku-Ombudsman, uma kudingeka.

6.1 Onesikhalo noma lelolungu elinesikhalazo ngesinqumo sika Ombudsman unemvume yokuthi afake isicelo sokuncenga kwi Appeal Tribunal.

6.3.3 uma ngabe lowo ofake isicelo, noma ilungu linakho ukuthi aphumelele ngaphambi kwe Appeal Tribunal yalesosikhathi.

6.4 Ilungu noma amalungu e Appeal Tribunal izoqokwa ngu Ombudsman kulabo abathintekayo, uma lokho kungaphumeleli kube imvume kalowo ophethe isihlalo se khansela noma uma engekho, uma amalungu amabili ekhansela engathintani naleli bhizinisi.

6.5 U Ombudsman uzolungisa I rekhodi lokuncenga ngokwe Appeal Tribunal.

6.6 Yonke imiphumela yendlla yokwenza noma kobufakazi izobhekwa yi Appeal Tribunal zingqotho zabo.

6.7 Isinqumo esikhishwe I Appeal Tribunal iyobe iyisibopho kulabo abathintekayo:

6.7.1 Uma ofake isikhalazo umdlulisi kubobonke labo abathintekayo;

6.7.2 Uma ngabe ilungu lingumdlulisi kulokho okuthintekayo.

6.8 Uma ngabe ofake isikhalazo engumdlulisi:

6.8.1 angadingeka ukuthi afake imali ngokusho kuka Ombudsman ayifake kwi trust account yommeli lowo okhethwe ngu Ombudsman;

6.8.2 Leyo mali iyohlala kuleso sikhwama se trust kuze kube kukhishwa isinqumo sokugcina sokuncenga;

6.8.3 Uma lokho kuncenga ngokwe Appeal Tribunal ingaphumeleli leyomali iyokhishwa ngu Ombudsman ngokuthi kukhokhwe izindleko zonke noma ingxenye yazo kukhokhelwe lowo ofake isikhalazo leyo esele ngaphandle.

6.9 Uma ngabe ilungu lingumdlulisi:

6.9.1 ukuncenga ngokubona kwe Appeal Tribunal kuyaphumelela, zonke izindleko ziyokhokhwa ngu Ombudsman;

6.9.2 Ukuncenga ngokubinwa iAppeal Tribunal ingaphumeleli lelo lungu liyokhokha zonke izindleko zokuncenga.

7. Bika

U-Ombudsman uzobika esidlangalaleni ngomhla zingama-31 kuNhlaba noma ngaphambi kwawo ngonyaka ngamunye ngemisebenzi yakhe ngonyaka wekhalenda odlule.

7.1 Uma ngabe lelolungu lingaphumeleli ukulandela izindlela zesixazululi esenziwe ngu Ombudsman:

7.1.1 Uyonikeza isaziso ukuthi asithathe leso sixazululo esikhathini esingamasonto amane noma ngaleso sikhathi u Ombudsman asishilo;

7.1.2 ekuhlulekeni noma ukunqaba kwelungu ngokwesaziso , u Ombudsman uyokubika kumphathi sihlalo we komiti ye Long Term Insurance yo Ombudsman (ikomiti).

7.2 U Ombudsman uyoqhubeka:

7.2.1 athole ukuthi uma ngabe lelo lungu anganikezwa ithuba lokuthi azisholo ngokwakhe ngikuthi lezizigcino ezingaphansi zingeke zisetshenziswe;

7.2.2 akusho emphakathini ngendlela ayibona ilungele ukushiwo ngayo ngokuthi anqabe noma alandele lesosaziso;

7.2.3 Aphelise noma ayekise ngokwemvume yekomiti ilungu elithintekayo;

7.2.4 akhiphe nanoma iyiphi indlela yokuthi kuze ayekiswe njena ingani ukuthi angaze abe ilungu.

 

8. Ulwazi ngo-Ombudsman

Amalungu abhalisele azodalula ukutholakala kanye nemininingwane yokuxhumana ye-Ombudsman ku:

8.1 abanikazi bamapholisi lapho kudayiswa khona nasekuxhumaneni ngezikhathi ezithile okufanele;

8.2 abafake izicelo lapho isicelo senqatshwa;

8.3 abamangali uma isikhalazo singaxazululwanga ngokuvumelana nabamangali;

8.4 amalungu omphakathi kusizindalwazi sawo nasemagcekeni awo.

 

9. Uxhaso

Amalungu Abhalisele azokhokha amalevi kanye nezindleko zecala i-Ombudsman ekhokhisa yona, ku-Ombudsman, uma kudingeka.
